These Terms of Use ("Terms") govern your access to and use of the website at vizdna.com (the "Site") and any applications published by VizDNA LLC ("VizDNA", "we", "us", or "our"), including VizGolf and other apps in the Viz portfolio (collectively, the "Apps"). By using the Site or the Apps, you agree to these Terms. If you do not agree, please do not use the Site or the Apps.
You must be at least 13 years old (or the minimum age required in your country) to use the Site or the Apps. By using our services, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
Some features may require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Please notify us at [email protected] if you believe your account has been compromised.

The Apps may allow you to create, upload, or share content such as scorecards, photos, videos, posts, or comments ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant VizDNA a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and improving the Site and the Apps and providing the features you've chosen to use. You are responsible for your User Content and represent that you have all rights necessary to share it.
The Site, the Apps, and all related content, features, and functionality (excluding User Content) are owned by VizDNA LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. The "VizDNA" name, the "Viz" prefix, the names of individual Viz apps, and associated logos and design elements are trademarks of VizDNA LLC. Nothing in these Terms grants you any right, title, or interest in those marks except as expressly permitted in writing.
Certain Apps may be made available as pre-release or beta software, including via Apple TestFlight. Beta versions are provided on an "as is" basis, may contain bugs or incomplete features, and may be modified or discontinued at any time. Feedback you provide about beta software may be used by VizDNA to improve our products without obligation to you.
The Site and the Apps may link to or integrate with third-party services. We are not responsible for the availability, content, or practices of third-party services, and your use of them is governed by their own terms.
The Site and the Apps are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or the Apps will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by law, VizDNA LLC and its officers, members, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Site or the Apps. Our total liability for any claim arising out of or relating to these Terms or the use of the Site or the Apps will not exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
You agree to defend, indemnify, and hold harmless VizDNA LLC and its officers, members, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or the Apps, your User Content, or your violation of these Terms.
We may suspend or terminate your access to the Site or the Apps at any time, with or without notice, including for conduct that we believe violates these Terms or is harmful to other users or to VizDNA. You may stop using the Site and the Apps at any time. Provisions of these Terms that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site or the Apps will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date and, where appropriate, provide additional notice through the Site or the Apps. Continued use of the Site or the Apps after a change becomes effective constitutes acceptance of the revised Terms.
